PREPROPOSAL STATEMENT OF INQUIRY
REVIEW BOARD
Subject of Possible Rule Making: 1. Procedures for conducting hearings for determination of release of community custody board (CCB) offenders.
2. Procedures for conducting violation hearings on CCB offenders after release.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 9.94A.712, 9.95.420, 9.95.430, 9.95.435, 9.95.440, 9.95.900.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Rules are needed on this subject for the following reasons:
1. Provide guidelines for conducting hearings for the indeterminate sentence review board (ISRB), department of corrections, assistant attorney general's office, defense attorneys and other stakeholders.
2. Ensure that the rights of the CCB offenders are being protected and that all hearings are conducted in a consistent and fair manner.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.
Process for Developing New Rule: Negotiated rule making.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication. The ISRB will compile a distribution list of stakeholders and interested parties that will be contacted and requested to provide input at scheduled meetings or in written format.
Information and status will be posed on the ISRB web site throughout the WAC drafting process.
