PREPROPOSAL STATEMENT OF INQUIRY

SUPERINTENDENT OF

PUBLIC INSTRUCTION

     Subject of Possible Rule Making: Academic achievement, accountability and assessment, chapter 392-501 WAC, a new series to cover elements of alternatives for special education students.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 28A.655.061 and 28A.155.045.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Legislation has authorized waiving of select requirements with linkage to developed alternatives for assessing students in special education. These new rules provide one alternative route for a defined set of students served under special education.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: Rules covering the intent of this code were included in emergency enactment in spring 2008, and since the conclusion of that school year it has been determined that this specific service should be covered by its own set of rules.
