Title of Rule and Other Identifying Information: Provisions relating to electronic authentication.
THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE. Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: This rule making will repeal WAC 284-01-050 dealing with electronic signatures.
Reasons Supporting Proposal: The current WAC 284-01-050 is unnecessary and conflicts with 15 U.S.C. § 7002 (a)(2)(ii), which bans a state law from requiring a specific technology or giving a specific technology greater legal preference in electronic signatures.
Statutory Authority for Adoption: RCW 48.02.060.
Statute Being Implemented: Title 48 RCW.
Rule is necessary because of federal law, 15 U.S.C. § 7002 (a)(2)(ii).
