PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: The department's rules regulating aquatic invasive species.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 77.12.047.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Pursuant to SHB 1778, passed in July 2009, the department needs to create a new rule to designate states and countries where aquatic invasive species have been detected. It also must amend certain rules that reference aquatic invasive species, including but not limited to WAC 232-12-168 and 232-12-016.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: The Washington state recreation and conservation office's aquatic invasive species council: The Washington department of fish and wildlife (WDFW) will coordinate with the council to ensure that rules comport with their goals as well as those of the department.

     Process for Developing New Rule:      Agency study.
