EMERGENCY RULES

[ Order 10-221 -- Filed September 3, 2010, 1:10 p.m. , effective September 8, 2010 ]


     Effective Date of Rule: September 8, 2010.

     Purpose: Amend personal use fishing rules.

     Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900X; and amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047 and 77.04.020.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: This emergency regulation will allow anglers to retain incidentally caught sockeye and/or salmon during the steelhead fishery allowing additional fishing opportunity. There is insufficient time to adopt permanent rules.

NEW SECTION
WAC 232-28-61900X   Exceptions to statewide rules -- Columbia River.   Notwithstanding the provisions of WAC 232-28-619, effective September 8 through October 15, 2010, it is permissible to fish for salmon in waters of the Columbia River from Wells Dam to Brewster. Daily limit six salmon, minimum size 20 inches in length. Up to three adult Chinook may be retained, of which no more than one may be a wild adult. Release all coho. Selective gear rules and night closure in effect. Except, bait is allowed.

     The following section of the Washington Administrative Code is repealed effective October 16, 2010:
