PREPROPOSAL STATEMENT OF INQUIRY
Subject of Possible Rule Making: WAC 308-391-602 Processor lien or preparer lien, Uniform Commercial Code (UCC).
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 60.13.040.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: As a result of HB 2362 which passed the 2012 legislature, the rule describing how to file certain liens in the UCC office needs to be amended. The department of licensing (DOL) needs to simply insert "wine producer" in the appropriate places.
Process for Developing New Rule: Communication with the public in general through the DOL/UCC web page and UCC listserv.
