     Following is the department of natural resources' semi-annual rules development agenda for publication in the Washington State Register, pursuant to RCW 34.05.314. The rule development actions shown below are to achieve consistency with RCW changes approved by the legislature.

     There may be additional rule-making activity not on the agenda as conditions warrant.

RULES DEVELOPMENT AGENDA

July to December 2012



     The department will adopt WAC 332-18-05001 rule change to achieve consistency with RCW 34.05.110(1), the Administrative Procedure Act related to small businesses notice requirements, as amended by 2011 legislative action. The intent is to make department of natural resources' rules consistent with Washington state statutes.

     The department will adopt WAC 332-18-01005 rule change to achieve consistency with RCW 78.44.085 (4)(a), the Surface Mine Reclamation Act, related to the annual fee for county governments, as amended by 2006 legislative action. The rule change will state that the fee is based on tonnage mined annually.

     The department will adopt WAC 332-18-01005 rule change to achieve consistency with RCW 78.44.085 (4)(b), the Surface Mine Reclamation Act, related to the annual permit fee for county governments, as amended by 2006 legislative action. The rule change will state that the annual fee will not exceed one thousand dollars.
