WSR 13-16-016 EMERGENCY RULES DEPARTMENT OF FISH AND WILDLIFE [Order 13-163—Filed July 25, 2013, 4:03 p.m., effective July 25, 2013, 4:03 p.m.] Effective Date of Rule: Immediately upon filing.
Purpose: Amend recreational fishing rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900N; and amending WAC 232-28-619.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Net pen reared triploid rainbow trout raised at upstream facilities on Rufus Woods Reservoir have escaped downstream into the Wells Pool area below Chief Joseph Dam. Removal of these fish is necessary to help reduce the incidence of competition and/or predation with juvenile Endangered Species Act listed anadromous species downstream. There is insufficient time to adopt permanent rules.

WAC 232-28-61900N Exceptions to statewide rules—Columbia River.
Notwithstanding the provisions of WAC 232-28-619, effective immediately through August 15, 2013, in waters of the Columbia River from Highway 173 Bridge in Brewster to Chief Joseph Dam: daily limit 10 trout, minimum size 12 inches in length. Barbless hooks are required.
