EMERGENCY RULES

Effective Date of Rule: June 18, 2015.
Purpose: Amend recreational fishing rules.
Citation of Existing Rules Affected by this Order: Amending WAC 220-310-180.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Low water is causing a delay in migration past the hatchery, resulting in greater vulnerability of the wild spring/summer chinook to fishing pressure. This is likely to remain a problem until stream flows increase in the fall. The Quileute Tribe is implementing a similar closure to subsistence fishing in the vicinity of the hatchery. This closure is needed to protect wild chinook. There is insufficient time to adopt permanent rules.

WAC 220-310-18000R Freshwater exceptions to statewide rulesCoastal
Notwithstanding the provisions of WAC 220-310-180, it is unlawful to violate the following provisions, provided that unless otherwise amended, all permanent rules remain in effect:
Sol Duc River (Clallam County) Effective June 18, 2015, until further notice it is unlawful to fish in those waters of the Sol Duc River from 200 feet below the Sol Duc Hatchery outfall creek upstream to the concrete pump station at Sol Duc Hatchery.
