Purpose: Amend recreational fishing rules.
Citation of Existing Rules Affected by this Order: Amending WAC 220-310-185.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: An emergency rule is needed as salmon are being released into the upper Cowlitz River for sport harvest opportunity and reintroduction purposes. After being released, the fish tend to temporarily congregate at the release site. Providing a small sanctuary will allow the fish to disperse and reduce the potential for snagging. There is insufficient time to adopt permanent rules.

WAC 220-310-18500I Freshwater exceptions to statewide rules—Southwest.
Notwithstanding the provisions of WAC 220-310-185, effective April 9, 2016, until further notice, it is unlawful to fish in the waters of the Cowlitz River from the Skate Creek (Franklin) Bridge in Packwood downstream 50 feet. Unless otherwise amended, all permanent rules remain in effect.
