EMERGENCY RULES

Effective Date of Rule: June 2, 2016.
Purpose: The purpose of this emergency rule is to allow residents who did not purchase a combination license due to the potential closure of the Puget Sound and surrounding tributaries an opportunity now to purchase a combination license at the difference in cost of their annual license and the combination license.
Citation of Existing Rules Affected by this Order: Amending WAC 220-55-040.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: With recent changes in the Puget Sound fishing season, there is a need to clarify and provide the opportunity to recreational anglers to purchase a combination license at the difference in cost of their annual license and the combination license. An emergency rule is needed to clarify this process which will make it easier for anglers to obtain a combination license. There is insufficient time to promulgate permanent rules.

NEW SECTION
WAC 220-55-04000A Recreational license, tag, permit, and stamp refunds, replacements, and exchanges.
Notwithstanding the provisions of WAC 220-55-040, effective immediately until further notice the following rules apply:
(8) A resident who has purchased an annual freshwater or saltwater license may upgrade to an annual combination license for the difference in cost between their current annual fishing license and the cost of the annual combination license.
