WSR 18-11-096 EMERGENCY RULES DEPARTMENT OF FISH AND WILDLIFE [Order 18-100—Filed May 18, 2018, 4:18 p.m., effective June 1, 2018] Effective Date of Rule: June 1, 2018. Purpose: Amend recreational fishing rules for the Stillaguamish River. Citation of Rules Affected by this Order: Repealing WAC 220-312-04000K; and amending WAC 220-312-040. Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest. Reasons for this Finding: This emergency rule is needed to close a portion of the mainstem Stillagumish [Stillaguamish] River due to concern over impacts to critically low Chinook salmon. The decision came from the list of agreed to fisheries which came out of North of Falcon talks for state and tribal agreed to fisheries. There is insufficient time to adopt permanent rules. WAC 220-312-04000K Freshwater exceptions to statewide rules—Puget Sound.
Notwithstanding the provisions of WAC 220-312-040, effective June 1 through June 30, 2018, it is unlawful to fish in those waters of the Stillaguamish River from Marine Drive to the forks. Cath and release is not allowed.
