EMERGENCY RULES

Effective Date of Rule: Immediately upon filing.
Purpose: Amend recreational fishing rules for the Entiat River.
Citation of Rules Affected by this Order: Repealing WAC 220-312-05000T; and amending WAC 220-312-050.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is necessary to improve anglers' effectiveness at removing hatchery-origin summer Chinook from the spawning grounds in an effort to reduce interactions with endangered spring Chinook further upstream. There is insufficient time to adopt permanent rules.

WAC 220-312-05000TFreshwater exceptions to statewide rulesEastside.
Notwithstanding the provisions of WAC 220-312-050, effective from one hour before official sunrise August 4 through one hour after official sunset September 30, 2018:
(1) Entiat River (Chelan Co.); From mouth (rail road bridge) to boundary marker/markers located approximately 1,500 feet upstream of the upper roaring Creek Road Bridge (immediately downstream of the Entiat National Fish Hatchery):
(a) Selective gear rules are not in effect.
(b) It is permissible for anglers to use one line with up to 2 single point barbless hooks.
(c) It is permissible for anglers to use bait.
REPEALER
The following section of the Washington Administrative Code is repealed effective one hour after official sunset September 30, 2018:
