Subject of Possible Rule Making: Rule making to support SHB 2322 relating to risk mitigation in property insurance, except commercial.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW
48.02.060 (3)(a), section 4 within SHB 2322 as codified in RCW
48.18.558 (1)(d),
48.18.559 (1), (2), (3), and (4).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Recently passed legislation, SHB 2322, permits property insurers, except commercial, to provide goods and/or services to their insureds in order to mitigate or prevent losses. The commissioner is considering rule making to address notice to insureds about their ability to opt out of risk mitigation programs, establishment of pilot programs by property insurers, and to identify what disaster or emergency response activities by property insurers are exempt from section 2 and 3 of SHB 2322, RCW
48.30.140 and
48.30.150.

Process for Developing New Rule: Submit written comments by September 30, 2018.
