Title of Rule and Other Identifying Information: WAC 246-827A-0040 Application requirements (forensic phlebotomist), the department of health is proposing an amendment to WAC 246-827A-0040 to correct a reference to the fee section of rules for forensic phlebotomists.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The purpose of the proposal is to correct a typographical error in the existing rule. WAC 246-827A-0040 incorrectly references a nonexistent section related to the required application fee for the forensic phlebotomist credential. A rule amendment is proposed to correctly state that fees for the forensic phlebotomist credential can be found under WAC 246-827A-990, rather than WAC 246-827A-900, which does not exist.
Reasons Supporting Proposal: This correction needs to be made to address any confusion that the current rule may cause. Changes need to be made so that the rule correctly refers to the fee rule for forensic phlebotomists, rather than the nonexistent rule that the application requirements section for forensic phlebotomists currently references.
Statutory Authority for Adoption: RCW 18.360.030 and 18.360.070.
Statute Being Implemented: RCW 18.360.040 and E2SHB 1614 (chapter 336, Laws of 2017).
Rule is not necessitated by federal law, federal or state court decision.

This notice meets the following criteria to use the expedited adoption process for these rules:
Corrects typographical errors, make address or name changes, or clarify language of a rule without changing its effect.
Explanation of the Reason the Agency Believes the Expedited Rule-Making Process is Appropriate: This rule making simply fixes an incorrect reference to the fee section in the application process section of rule for the forensic phlebotomist credential. The expedited rule-making process is appropriate pursuant to RCW 34.05.353(1) in that it only corrects a typographical error within a rule without changing its effect.

AMENDATORY SECTION(Amending WSR 18-14-016, filed 6/25/18, effective 7/26/18)
WAC 246-827A-0040Application requirements.
An applicant for a forensic phlebotomist credential must submit the following to the department:
(1) Completed application on forms provided by the department;
(2) Proof of successful completion of the required education or approved training program described under WAC 246-827A-0030;
(3) Proof of completing seven clock hours of HIV/AIDS education as required by chapter 246-12 WAC, Part 8;
(4) Proof of current employment as a law enforcement or police officer, or current employment at a detention or correction facility;
(5) Any fee required in WAC ((246-827A-900))246-827A-990;
(6) Fingerprint cards for national fingerprint based background check pursuant to RCW 18.130.064(2), if requested by the department; and
(7) Any additional documentation or information requested by the department.
