EMERGENCY RULES

Effective Date of Rule: April 17, 2019.
Purpose: Amends freshwater recreational rules for Sarg Hubbard Park Pond.
Citation of Rules Affected by this Order: Repealing WAC 220-312-05000E; and amending WAC 220-312-050.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This rule change is necessary to ensure a successful youth fishing event. Several thousand rainbow trout will be stocked prior to the event for acclimation. This helps ensure they will bite while the kids are fishing. During the event, only registered kids will be allowed to fish. There is insufficient time to adopt permanent rules.

WAC 220-312-05000EExceptions to statewide rulesSarg Hubbard Park (aka Reflection) Pond.
Notwithstanding the provisions of and WAC 220-312-050, effective 12:01 a.m. April 17, through 4:00 p.m. April 20, 2019, it is unlawful to fish in Sarg Hubbard Park Pond, except as provided in the sections below:
(a) Open to fishing 8:00 a.m. to 4:00 p.m. April 20, 2019, by juvenile anglers participating in the Yakima Greenway Association's "Kids' Fish-In" event.
(b) The daily limit is reduced to two (2) trout during the youth fishing event.
