Subject of Possible Rule Making: The department is planning to add new sections and amend existing sections in chapter 388-97 WAC, Nursing homes, including WAC 388-97-1090 Direct care hours, and other related rules as may be required.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW
74.42.620.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The department is amending WAC 388-97-1090 and other related rules as may be required to implement ESHB 1548 and HB 1349. ESHB 1548 requires the department to establish rules that allow a geriatric behavioral health worker to be recognized in the minimum staffing requirement as part of the direct care service delivery. ESHB 1548 requires these rules include standards or requirements for work skills, work experience, training and supervision. HB 1349, passed after ESHB 1548, alters the definition of geriatric behavioral health worker and redefines the standards or requirements for training and work experience.
