Effective Date of Rule: October 7, 2019.
Purpose: Amend recreational fishing rules for the Skagit River.
Citation of Rules Affected by this Order: Repealing WAC 220-312-04000Z; and amending WAC 220-312-040.
Under RCW 34.05.350
the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed to close a portion of the Skagit River to all fishing to avoid gear conflicts with treaty fisheries during these scheduled dates. These closures were agreed to with comanagers during the 2019/2020 North of Falcon process. Exact dates were to be determined based on in-season information such as stream flow and run timing. These dates have now been set, there is insufficient time to adopt permanent rules.

Notwithstanding the provisions of WAC 220-312-040:
Skagit River: From the Highway 9 Bridge to the Baker River - Closed to all fishing the days of October 7 through October 9, 2019.
The following section of the Washington Administrative Code is repealed effective October 10, 2019:
