PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Chapter 308-30 WAC, Notaries public.

Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 42.45.250.

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Rule changes are necessary to update the WAC to incorporate changes required by SB 5641 to establish new rules for remote notarization by notary licensees. SB 5641 is effective October 1, 2020, and was passed by the 2019 legislature which allows a Washington notary public to perform remote notarization.

Process for Developing New Rule: Department staff will converse with interested stakeholders on proposed amendments. Stakeholders will have the opportunity to discuss at public meetings, provide written comments and can provide testimony at the public meeting.
