PREPROPOSAL STATEMENT OF INQUIRY
SUPERINTENDENT OF
PUBLIC INSTRUCTION
[Filed January 6, 2021, 9:06 a.m.]
Subject of Possible Rule Making: Chapter 392-132 WAC, Finance—Nonhigh participatory finance.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The office of superintendent of public instruction (OSPI) is considering rule making to address capital construction agreements entered into by host and nonhigh school districts. Current rules could cause nonhigh school districts to be vulnerable to dissolution if the district and host high school district cannot agree to terms of capital construction financing. Amending the rules would provide nonhigh districts with basic protections and ensure host districts are able to secure necessary financing of capital construction projects.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.
Process for Developing New Rule: Early solicitation of feedback and recommendations respecting new or amended rules, and consideration of the comments and recommendations in the course of drafting rules.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication by contacting Scott Black, OSPI, P.O. Box 47200, Olympia, WA 98504, phone 360-742-4028, TTY 360-664-3631, email Schoolfacilitiesrules@k12.wa.usi [Schoolfacilitiesrules@k12.wa.us].
