NOTICE
Title or Subject: Medicaid State Plan Amendment (SPA) 21-0021 Special Income Level Resource Disregard - Medicaid Disaster Relief.
Effective Date: November 2, 2020.
Description: The health care authority (HCA) intends to submit SPA 21-0021 to provide a disregard of income and resources when applying rules of the individuals in institutions under a special income level eligibility group as described in Section 1902 (a)(10)(A)(ii)(V) of the Social Security Act. These rules apply to programs that provide long-term services and supports. When determining eligibility for this group, HCA will: (1) Disregard income that would have otherwise been part of an individual's liability for his or her institutional or home and community-based waiver services based on application of the post-eligibility treatment-of-income (PETI) rules but which became countable resources on or after March 18, 2020; and (2) disregard as resource funds in a designated separate account that consists only of earnings resulting from work activity while enrolled in the Ticket to Work and Balanced Budget Act work incentives eligibility groups.
HCA anticipates SPA 21-0021 will have no effect on payments/expenditures.
