EMERGENCY RULES

Effective Date of Rule: August 17, 2022.
Purpose: The purpose of this emergency rule is to close Chinook retention in Catch Record Card Area 11, except for year-round piers.
Citation of Rules Affected by this Order: Amending WAC 220-313-060.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is necessary because the current estimate of Chinook harvest for the summer is 2,724 (97 percent) of the total harvest quota of 2,816 and 2,247 (67 percent) of the total sublegal encounter limit of 3,373 agreed to in this year's list of agreed fisheries. The harvest quota for Chinook is nearly taken, suspending Chinook retention now will allow coho retention to continue through the summer. There is insufficient time to adopt permanent rules.

WAC 220-313-06000HPuget Sound salmon—Saltwater seasons and daily limits.
Effective August 17 through September 30, 2022, for Catch Record Card Area 11, except year-round piers listed in WAC 220-313-060 (9)(g), the following provisions of WAC 220-313-060 regarding salmon seasons shall be modified as described below. All other provisions of WAC 220-313-060 not addressed herein, or unless otherwise amended by emergency rule, remain in effect:
(a) Open daily.
(b) Daily limit 2.
(c) Release Chinook and chum.
