Modernize rule on the format of hearings and depositions.
Current BIIA rules treat the in-person format as the default format for BIIA hearings and depositions. Experience with remote and hybrid proceedings since March 2020 shows that remote and hybrid appearances can be effective. Amend the rule to make it easier for judges to permit remote or hybrid appearances by participants, while still requiring criteria for such determinations.
