Title or Subject: Medicaid State Plan Amendment (SPA) 23-0001 Community First Choice Tribal Adult Family Homes.

Effective Date: July 1, 2023.

Description: State law, RCW 70.128.122, recognizes that adult family homes (AFHs) located within the boundaries of federally recognized tribal lands may be licensed by an Indian tribe. In recognition of tribal sovereignty and state law, health care authority (HCA) and the department of social and health services (DSHS) intend to submit SPA 23-0001 to incorporate tribal AFHs as medicaid providers of the community first choice (CFC) program.

To provide CFC services, tribal AFHs will meet the state AFH licensing requirements. The federally recognized tribe will perform initial inspections, routine inspections, and complaint investigations for tribal AFHs. Tribal AFHs will be paid an enhanced rate for providing culturally-relevant personal care services.

SPA 23-0001 is expected to have no effect on the annual aggregate expenditures/reimbursement/payment for services.

A copy of SPA 23-0001 is available for review. HCA and DSHS would appreciate any input or concerns regarding this SPA.
