Title or Subject: Medicaid State Plan Amendment (SPA) 23-0032 Civil Commitment Enhancement.

Effective Date: July 1, 2023.

Description: The health care authority (HCA) intends to submit medicaid SPA 23-0032 in order to provide for a rate enhancement to providers that serve apple health clients who are committed to a psychiatric hospital pursuant to the dismissal of criminal charges. The rate will not apply to hospitals that receive a long-term civil commitment rate that is 100 percent of their costs.

SPA 23-0032 is expected to increase the annual aggregate payment for hospitals that accept apple health members who are experiencing a conversion from criminal commitment to civil commitment. The rate is based on the number of hours of protective supervision required in the facility. Nine to 16 hours a day of protective supervision will be paid $246.66 additional per day and 16-24 hours a day of protective supervision will be paid $331.66 additional per day.
