Following is the department of enterprise services' (DES) semi-annual rules development agenda. This list identifies rules that DES has under active development and rules that DES anticipates starting some rule-making action on during the next six months.
This agenda also is available on our rule-making website. We update rule-making information on our website as rule-making progresses. If we start rule-making activities not listed on this agenda or stop listed rule-making activities, we immediately post that information to our rule-making website and inform interested and known affected parties.

Chapter 200-330 WAC, Small works roster
The 2023 legislature passed E2SB [2SSB] 5268, Efficiency and equity in public works contracting, to increase equity in public works contracting by helping small, minority, women, and veteran-owned businesses secure public works contracts. Key elements of the bill:
• Establish a statewide works roster and a small business certification program.
• Align financial public works contracting thresholds throughout the state.
• Add a direct contracting option.
• Require DES to create public works bid templates for state agencies with public work authority.
Rule making is needed to align the current rules with the bill.
The proposed rules public comment period ended January 12, 2024.
We anticipate filing a permanent rule-making order (CR-103P) in February 2024.
