PREPROPOSAL STATEMENT OF INQUIRY
LIQUOR AND CANNABIS
BOARD
[Filed February 14, 2024, 10:18 a.m.]
Subject of Possible Rule Making: Title 314 WAC; the Washington state liquor and cannabis board (LCB) is considering amending or repealing WAC 314-11-050 regarding prohibited conduct at liquor license premises.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 66.08.030, 66.98.070.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: WAC 314-11-050 identifies prohibited conduct and behavior of patrons and employees at liquor license premises. This rule language is unchanged from when it was put into WAC 314-11-050 in 2001, when WAC 314-16-125 was repealed and most of its language put into WAC 314-11-050. WAC 314-16-125 was created in 1975, then revised in 1981, 1982, and 1992.
Based on extensive stakeholder feedback, LCB is examining whether revisions need to be made to the language of the rule or if the rule needs to be repealed.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.
Process for Developing New Rule: Collaborative rule making.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication by contacting Daniel Jacobs, Policy and Rules Coordinator, P.O.
