Following is the department of children, youth, and families (DCYF) semi-annual rule-making agenda for July 1 through December 31, 2024. This agenda will be published in the Washington State Register as required in RCW 34.05.314 and distributed to interested parties. It is also available on the DCYF rule-making web page.
This agenda represents DCYF rule making that is anticipated or currently under development. There may be additional rule-making activities needed to implement legislative actions, comply with federal mandates, or meet unforeseen circumstances.

Working Connections and Seasonal Child Care (WCCC and SCC): Amending to Expand eligibility to people working in licensed child care centers and licensed family homes, specialty and therapeutic court participants, and undocumented children. This rule making will also establish eligibility for families with a parent participating in a state-registered apprenticeship with income less than 85 percent of the state median income who, within the last year, were approved for WCCC.

WCCC and SCC: Amending rules on the eligibility requirements for child care and food assistance. DCYF is also amending rules to allow the following programs to be an approved activity for eligibility: Birth to three early childhood education and assistance program (ECEAP) and early head start programs. These amendments are required by legislation.

Foster Parent Liability Fund and Property Damage Reimbursement: Amending rules to correct the address for submitting reimbursement forms; allow for reimbursement to unlicensed caregivers; and increase the reimbursement limit from $5,000 to $10,000.

Extended Foster Care (EFC): Amending the EFC program WAC in chapter 110-90 WAC and other related rules as required by SB 5908, which took effect June 6, 2024. These changes will reduce systemic barriers to youth who are dependent at the age of 18 and voluntarily enroll in the EFC program by eliminating the federal eligibility requirements.

Group Care: Amending group care rules to be more developmentally and culturally appropriate and flexible to meet individual youth's needs. Additionally, the project will allow DCYF to best determine how these licensing WACs can better accommodate the most relevant and beneficial programming and settings as possible, all while maintaining minimum health and safety standards. WAC changes will be made using negotiated rule making.

Licensing Standards for Kinship Caregivers: Amending rules to remove child-specific items to accommodate a new WAC chapter that will outline the licensing standards for kinship caregivers. This will allow for DCYF to issue child-specific licenses to kinship caregivers and eliminate the need to use nonsafety exemptions and waivers. This will reduce barriers and create better equity for kinship caregivers trying to become licensed. These updates will also provide greater stability and outcomes for children entering foster care.

Licensing Requirements for Professional Therapeutic Foster Parents: DCYF is required to develop a contract and licensing category for professional therapeutic foster care (PTFC) according to the D.S. Settlement Agreement. The licensing division (LD) must update sections of chapter 110-148 WAC to satisfy this legal requirement. Currently, foster family home licensing rules do not allow foster care payments to be the sole income of a licensed foster family home. Accordingly, to meet the terms of the settlement agreement, LD must remove this barrier in licensing rules and add new language describing the existence, eligibility, and licensing requirements for professional therapeutic foster parents.

Gender-Neutral Pronouns: Amending several DCYF WAC to reflect gender-neutral pronouns. The WAC currently use he/she or his/her instead of they/them. Other minor housekeeping changes are also being made.
