Following is the department of enterprise services' (DES) updated semi-annual rules development agenda. This list identifies rules that we have under active development and rules that DES anticipates starting some rule-making action on during the next three months.
This agenda also is available on our rule-making website. We update rule-making information on our website as rule making progresses. If we start rule-making activities not listed on this agenda or stop listed rule-making activities, we immediately post that information to our rule-making website and inform interested and known affected parties.

Purpose of Rule Making

Title 200
The rule making is limited in scope. The purpose is to expand Title 200 WAC to:
• Establish a clear process to verify that benefits are going to small businesses as intended, including a standard compliance process.
• Make sure in-state businesses have increased opportunities for contracts under statewide procurement policies.
• Support existing strategies encouraged by the statewide supplier diversity policy, such as preference points and reserved awards, to boost use of Washington small business.
- DES uses a point system when evaluating vendor solicitations. Preference points are added points for small businesses.
- Reserved awards are contracts set aside for small/Veteran-owned businesses under a multiple-award competitive solicitation.
• Enhance reporting on small business use in state contracting.
We filed a CR-101 preproposal statement of inquiry with the office of the code reviser in September 2024. See WSR 24-19-015.
We anticipate filing a proposed rule (CR-102) in May 2025.
