PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: The department of social and health services (department) is considering writing new rules to regulate providers of emergency transitional support services (ETSS), which are currently outlined in chapter 388-829Z WAC, and other related rules as may be required.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW
71A.26.040.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: In accordance with the department's approved budget recommendation, residential care services (RCS) is planning to write new rules to establish a certification process that regulates ETSS providers. RCS will collaborate closely with the developmental disabilities administration throughout this rule-making process. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.
Process for Developing New Rule: The department will use a collaborative rule-making process and notify interested parties of the opportunity to participate in development, review, and comment on the amended draft rules prior to proposing the amendment for adoption. The department welcomes the public to take part in developing the rules and anyone interested should contact the department representative listed below.
