Semi-Annual Agenda for Rules under Development

DIVISION OF CONSUMER SERVICES:
Check Cashers and Sellers Act. Finalize and adopt the rule making to increase the information system database fee. The preproposal statement of inquiry for the rule making was filed on September 16, 2024. The division of consumer services also plans to begin, finalize, and adopt rules under chapter 208-660 WAC to clarify the requirements related to data security and notification of security events. Further, make technical and other changes as may be required by changes to state or federal law.
Consumer Loan Act. Begin, finalize, and adopt rules under chapter 208-620 WAC to clarify the requirements related to the Predatory Loan Prevention Act (SSB 6025), home equity sharing agreements, and data security and notification of security events. Also, make technical and other changes as may be required by changes to state or federal law.
Escrow Agent Registration Act. Begin, finalize, and adopt rules under chapter 208-680 WAC to clarify the requirements related to data security and notification of security events. Also, make technical and other changes as may be required by changes to state or federal law.
Mortgage Broker Practices Act. Begin, finalize, and adopt rules under chapter 208-660 WAC to clarify the requirements related to data security and notification of security events. Also, make technical and other changes as may be required by changes to state or federal law.
Uniform Money Services Act. Begin, finalize, and adopt rules under chapter 208-690 WAC to add provisions to strengthen consumer protections related to virtual currency, and clarify the requirements related to data security and notification of security events. Also, make technical and other changes as may be required by changes to state or federal law.
DIVISION OF SECURITIES:
Updates to the investment adviser rules in chapter 460-24A WAC: The division [of securities] plans to propose amendments to the investment adviser rules contained in chapter 460-24A WAC to incorporate updates to similar rules adopted by the SEC and NASAA, including advertising rules, continuing education requirements, and rules concerning unpaid arbitration awards.
