PREPROPOSAL STATEMENT OF INQUIRY

RETIREMENT SYSTEMS

Subject of Possible Rule Making: Implementing chapter 359, Laws of 2024, which allows membership in the public safety employees retirement system (PSERS) for certain department of social and health services (DSHS) employees.

Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 41.50.050 and chapter 359, Laws of 2024.

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Under chapter 359, Laws of 2024, DSHS employees are eligible to become members of PSERS if they work at DSHS institutional or residential sites and serve civilly committed residents or patients who are found to be not guilty by reason of insanity findings. The department of retirement systems (DRS) is doing rule making to align the current rule language with the new law.

Process for Developing New Rule: Negotiated rule making.
