EMERGENCY RULES
DEPARTMENT OF
FISH AND WILDLIFE
[Order 25-36—Filed March 7, 2025, 3:51 p.m., effective March 12, 2025, 8:00 a.m.]
Effective Date of Rule: March 12, 2025, 8:00 a.m.
Purpose: This rule opens a limited Cowlitz River recreational fishery for eulachon smelt.
Citation of Rules Affected by this Order: Repealing WAC 220-315-03000G; and amending WAC 220-315-030.
Under RCW
34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This rule sets a limited Cowlitz River recreational fishery for eulachon smelt. Recent landings in the mainstem Columbia River commercial fishery indicate the eulachon smelt run size is large enough to support these recreational openings, per management guidance found in the 2023 Washington and Oregon Eulachon Management Plan. There is insufficient time to adopt permanent regulations.
