PREPROPOSAL STATEMENT OF INQUIRY
COLUMBIA BASIN COLLEGE

Subject of Possible Rule Making: Columbia Basin College's (CBC) Title IX hearing procedure for students, under chapter 132S-110 WAC, and other related rules as necessary.
Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 34.05 RCW; RCW 28B.50.140(13).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: On January 9, 2025, the federal district court in Kentucky ruled that the 2024 regulations/changes be vacatur; Title IX regulations were vacated in part, necessitating a review and potential revision to CBC's Title IX student procedure to ensure compliance with the most current legal framework from 2020. Given this regulatory shift, the existing student grievance procedures may require updates to reflect the reinstated federal standards or any requirements that protect student rights and institutional responsibilities under Title IX.
Updating these procedures will provide clarity for students, faculty, and staff regarding their rights and obligations under Title IX, ensure the institution's compliance with federal and state nondiscrimination laws, and maintain a fair, transparent, and legally sound process for handling complaints of sex-based discrimination, including sexual harassment and assault.
