PREPROPOSAL STATEMENT OF INQUIRY
TRANSPORTATION COMMISSION

Subject of Possible Rule Making: Puget Sound Gateway (PSG) facility (SR 167 Expressway and SR 509 Expressway) toll rates, fees, and policies.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 47.56.030, 47.56.795, 47.56.850, and 47.56.895.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Per RCW 47.56.895, the PSG facility, which includes the SR 167 Expressway and SR 509 Expressway, is designated as an eligible toll facility. The Washington state transportation commission (WSTC) is required under RCW 47.56.895 to set a variable schedule of toll rates to maintain travel time, speed, and reliability on the PSG facility. Tolling on the SR 509 Expressway is expected to begin in October 2025, whereas tolling on the SR 167 Expressway is expected to begin in December 2026. This rule is necessary for WSTC to set toll rates and toll rate policies before the facilities open to support program construction and ongoing operations and maintenance costs.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Other agencies that regulate this subject are the Washington state department of transportation as the operator of the tolled facilities, and the office of the state treasurer, who oversees the financing of tolled facilities. WSTC works closely and coordinates with both agencies in developing toll-setting proposals and carrying out the rule-making process for making toll adjustments.
