This memo serves as notice that the department of health (department) is rescinding Policy Number CHS-04-08-24, Enforcement of Opioid Treatment Program Rules in chapter 246-341 WAC, which was filed May 24, 2024, and published in WSR 24-12-021.
Under this policy, the department did not enforce certain requirements for the licensing and certification of opioid treatment programs (OTP) in chapter 246-341 WAC, due to changes in the federal regulations related to OTP certification and standards for the treatment of opioid use disorder under 42 C.F.R. Part 8.
This policy is being rescinded because the department officially filed a CR-103P on January 7, 2025, and published in WSR 25-03-021, for chapter 246-341 WAC, Behavioral health agency licensing and certification requirements. The updates to chapter 246-341 WAC align state regulations with federal certification and treatment standards for OTPs in 42 C.F.R. Part 8.
The rules became effective January 31, 2025; therefore, the policy statement is no longer needed.
