PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: The department of social and health services (DSHS) is creating rules for the long-term services and supports trust program. The rule making will address eligible relative care, which will be the third option for qualified family members to receive payment for personal care services, and other related rules as appropriate.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 50B.04.020 (3)(j).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: This section of rule will address the approved service of eligible relative care, including registration and contracting, administrative management, limitations, hiring requirements for beneficiaries, and other topics identified as being necessary for eligible relative care.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Employment security department and health care authority. Coordination will occur between departments for consistent implementation of the WA Cares program under chapter 50B.04 RCW.
Process for Developing New Rule: DSHS welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, DSHS will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
