EFFECT: The criteria for determining whether an instrumentality is a public hazard is revised to strike the requirement that the instrumentality has caused injury to another person or persons (other than the plaintiff.) An instrumentality is a public hazard if the instrumentality presents a real and substantial potential for repetition of the harm inflicted or involves a single incident which affected or was likely to affect many people.
