     Reletter the remaining subsections consecutively and correct internal references accordingly

EFFECT:  The definition of public hazard is amended to define a public hazard as an instrumentality that previously caused injury to another person or persons or presents a real and substantial potential for repetition of the harm inflicted or involves a single incident which affected or was likely to affect many people.

The substitute bill as passed the Judiciary committee provides an instrumentality is a public hazard if the instrumentality previously has caused injury to another person or persons and presents a real and substantial potential for repetition of the harm inflicted or involves a single incident which affected or was likely to affect many people.
