     On page 36, after line 12, insert the following:

     "(3)(a)  Notwithstanding subsection (1) of this section, an employee may be required to work all or part of the next succeeding work shift following the work shift completed by the employee if:

     (i)(A) In good faith, the employer has exhausted reasonable attempts to obtain voluntary work to complete the succeeding shift; or

     (B) The employee has critical skills and expertise that are required to complete the shift; and

     (ii) As requested by the employee, the employer has assisted the employee to acquire safe transportation to his or her residence following the succeeding shift, and has assisted the employee to address child care or other family obligations successfully.  At the time of requiring the employee to work all or part of the next succeeding shift, the employer shall inform the employee of the employer's obligation under this subsection.

     (b)  In no case does this subsection permit an employer to require an employee to work more than two work shifts in succession.

     (c)  This section shall apply only to employees who are employed in a work place of the employer that routinely operates twenty-four hours a day."

 

     Renumber the subsections consecutively and correct any internal references accordingly.

 


EFFECT:  Permits businesses with continuous operations to require employees to work the next succeeding work shift if the employer has exhausted reasonable attempts to get voluntary work or if the employee has critical skills and expertise that are required to complete the shift, and the employer has, at the employee's request, assisted the employee to acquire safe transportation home and to address child care or other family obligations successfully.
