     On page 2, line 10, after "Sec. 3." strike all material through "may" on page 2, line 11, and insert "If an appropriate enforcing agency has reason to believe that a violation of this chapter has occurred, the enforcing agency shall issue an order of noncompliance to the alleged violator, informing the alleged violator that a civil action shall begin in one week if the tobacco vending machine is not brought into compliance with this chapter.  If after one week the tobacco vending machine has not been brought into compliance, the enforcing agency shall"

EFFECT:  Requires an enforcing agency to issue an order of noncompliance, with a one week warning, before it will initiate a civil law suit.  Removes the authority of a private citizen to bring a civil law suit.
