     On page 34, beginning on line 1, after "total of" strike all material through "1996." on line 2, and insert "twenty-five percent of all able and eligible inmates are employed in class I and class II programs by December 30, 1996 and fifty percent by December 30, 1998."

     On page 34, beginning on line 8, strike "fifty percent of their gross wages, up to six dollars per hour," and insert "a percent of their gross wages, which percent shall be determined by the department,"

     On page 34, line 18, after "amenities." insert "The department shall adopt a formula to determine the percent of gross wages that an inmate is required to pay under this section."

     On page 34, after line 23, insert a new section to read as follows:

     "NEW SECTION.  Sec. 15.  By January 1, 1993, the secretary of corrections shall submit a report to the chief clerk of the house of representatives and secretary of the senate containing an identification and description of any impediments which the secretary believes might prevent the department from achieving compliance with the inmate work participation percentages specified in section 14.  The secretary also shall include, in the report, alternative ways to remove any identified impediments.  The chief clerk and secretary shall distribute the report to the appropriate standing committees."

 

 


     EFFECT:  By December 30, 1996, the Department will have to have at least 25% participation in Classes I and II industries and by December 30, 1998, 50% participation.

For inmates working in Classes I through IV industries, the Department of Corrections will adopt a formula specifying what  percent of their wages that will be applied toward their incarceration costs.

     The Secretary is directed to report to the Legislature on impediments to reaching the 25% and 50% work participation requirements.
