     On page 2, line 23, after "NEW SECTION.    Sec. 2." insert the following:    "Notwithstanding the provisions of section 1 of this act, when any party participates in mediation conducted by an agency under the provisions of a collective bargaining law or similar statute, the agency's rules govern questions of privilege and confidentiality.

NEW SECTION.  Sec. 3."

     Renumber the sections consecutively and correct any internal references accordingly.

EFFECT:  Mediations conducted during a labor dispute involving public employees which is governed by state law are exempt from the provisions of the bill.
