On page 2, after line 11, insert the following:

"(2) A water right may not be changed from a right exercisable on a seasonal basis only to a right exercisable throughout a calendar year or other seasonal basis, or to a new beneficial use, when such change is for ground water resources in a ground water management area or sub-area designated by the department pursuant to chapter 90.44 RCW and such change would exceed the average annual amount actually applied to a beneficial use during, at a minimum, the five years preceding any request or inquiry to the department regarding such change or related transfer."

Renumber remaining subsections consecutively and correct internal references accordingly.

EFFECT: A ground water right may not be changed from seasonal to one exercisable throughout the year if the change is for a ground water management area or sub-area and the change would exceed average annual amount beneficially used during, at a minimum, the five years preceding the request.
