On page 3, line 5, after "felony." insert the following:

"NEW SECTION. Sec. 3. A new section is added to chapter 9A.56 RCW to read as follows:

Sections 1 and 2 of this act do not apply to any of the following:

(1) A person who furnishes goods or services on the business premises of a merchant and who possesses, deposits, negotiates, or obtains payment of a credit card charge through that merchant's account or agreement; and

(2) A merchant who permits a person described in subsection (1) of this section to process, deposit, negotiate, or obtain payment of a credit card charge through that merchant's account or agreement."
