    Strike everything after the enacting clause and insert the following:

    "NEW SECTION. Sec. 1.  A new section is added to chapter 60.11 RCW to read as follows:

    A consignment of an orchard crop by a producer to a handler for preparation for market, as that preparation is described in RCW 60.11.010(2), does not vest in the handler any right or interest in the crop other than to perform such preparation in accordance with the terms of the consignment.

    If, without the express consent of the producer, the handler pledges or creates a security interest in the consigned orchard crop, such pledge or security interest is void as against the producer; and the producer's right, title, and interest in and to the crop and the proceeds thereof remain in the producer, free and clear of such pledge or security interest.

    This section does not apply to or impair a handler's lien created under RCW 60.11.020(3) or a security interest acquired by the handler under a security agreement signed by the producer."
