    On page 5, after line 19 of the amendment, insert the following:

    "NEW SECTION. Sec. 9.  A new section is added to chapter 36.58 RCW to read as follows:

    The legislative authority of a county may by ordinance impose a fee on solid waste received at a solid waste landfill or incinerator from a source outside the boundaries of the county.  Prior to imposing a fee, representatives of the legislative authority, or its designees, shall first meet and confer with any affected solid waste landfill or incinerator owners or operators to determine the basis, terms, conditions, and limitations of the fee.  The owners or operators of solid waste landfills or incinerators shall be given sixty days' notice prior to the effective date of the fee."

    "NEW SECTION. Sec. 10.  A new section is added to chapter 36.58 RCW to read as follows:

    If a new solid waste landfill or incinerator that will receive solid waste from a source outside the county's boundaries is  proposed, determination of a fee under section 9 of this act shall be made no later than sixty days after:  (1) The filing of an application for a permit or zoning reclassification; (2) the date of adoption of an amendment to the county's comprehensive solid waste management plan under chapter 70.95 RCW that allows solid waste from a source outside the county's boundaries; or (3) the date of award of a contract resulting from a procurement process under this chapter for a solid waste landfill or incinerator that will receive solid waste from a source outside the county, whichever occurs first after the effective date of this act."

    "NEW SECTION. Sec. 11.  If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected."

    Renumber the remaining sections consecutively and correct any internal references accordingly.
