BACKGROUND:

 

The process for a county to vacate and abandon a road is initiated by ten "freeholders residing" in the vicinity of the road filing a petition with the county legislative authority requesting the vacation.  A freeholder is a person holding either legal or equitable title to property.

 

SUMMARY:

 

The signature requirement on a petition initiating the process to vacate a county road is altered from ten freeholders residing in the vicinity of the road that is proposed to be abandoned to ten owners of an interest in any real estate in the vicinity of the road that is proposed to be abandoned.  Owners of an interest in real property may include not only legal and equitable title holders but lessors as well.
