BACKGROUND:

 

Cities may permit a community municipal corporation to be created in an area that annexes to the city or town. 

 

A community municipal corporation may disapprove the following actions taken by the city or town council relating to the community municipal corporation:  a comprehensive plan; a zoning ordinance; a conditional use permit, special exception or variance; a subdivision ordinance; a subdivision plat; and a planned unit development.

 

Community municipal corporations have been created in Bellevue, Kirkland, and Des Moines, each of which are code cities.

 

SUMMARY:

 

It is clarified that community municipal corporations may be formed whenever two or more code cities consolidate or whenever unincorporated territory is annexed to a city or town if the service area meets the statutory size requirements.

 

The community municipal corporation must be approved by the voters in the cities being consolidated or in the territory being annexed.  The ballot proposition can be for the creation of the community municipal corporation alone or for the approval of both the consolidation or annexation and the creation of the community municipal corporation.
