Brief Description:  Authorizing the governor to appoint the secretary of transportation.

BACKGROUND:

 

The Secretary of Transportation currently is appointed by and answers to the Transportation Commission, a seven member board appointed by the Governor, with the consent of the Senate.  The Governor has no direct authority over the Secretary.  The Secretary can be removed by the commission, but only for incapacity,  incompetence, neglect of duty, malfeasance in office or failure to carry out the commission's policy.

 

SUMMARY:

 

The Governor appoints the Secretary of Transportation with the consent of the Senate.  The Secretary answers directly to and holds office at the pleasure of the Governor.
